Catalonia: the new rental rules in 2026

2026 is the year several reforms passed at the end of 2025 took effect in Catalonia. For landlords and buy-to-let investors alike, the rules have changed.

1 January 2026: seasonal and room rentals regulated

Catalan Law 11/2025 of 29 December 2025, in force since 1 January 2026, ends a widespread practice in Barcelona: renting "seasonally" to avoid rent caps.

  • Temporary lets for work, study or medical reasons now follow residential lease rules, including how rent is set and updated. In stressed-market areas, rent caps apply.
  • The temporary purpose must be documented with Incasòl when the deposit is lodged. Without proof, or if renewed without proof, the lease is presumed to be a main residence.
  • Room rentals are regulated: in a building in a stressed-market area, the combined rents of the rooms cannot exceed the maximum rent for the whole flat.
  • A lease supervision commission was created, and existing contracts had to be adapted during Q1 2026.

14 July 2026: large landlord from five homes

Law 11/2026 of 9 July 2026, in force since 14 July, lowers the threshold for being considered a "large landlord" to five or more homes in Catalonia (or ten in Spain), for new leases signed from 1 August 2026. This status brings stricter obligations.

The same law widens the definition of rent to indirect payments (charges, services, compulsory fees), bans passing management and contract costs on to tenants, and requires a valid habitability certificate before a rental is even advertised, with fines of €3,000 to €9,000. Rents up to 5% above the legal maximum can be corrected without penalty if fixed in time.

Under discussion: the anti-speculation bill

In February 2026, the Catalan government and the Comuns agreed on a bill to restrict home purchases in stressed-market areas to main residences, capped-rent lettings or family housing. It reached Parliament in July. In August, the Consell de Garanties Estatutàries raised constitutional concerns, and the text is being revised. Buying a main residence is not targeted.

Key takeaways if you are buying

  • For a main residence, these rules do not restrict your purchase.
  • For a rental investment, calculate yield on a capped rent; seasonal letting is no longer a way around it.
  • Check the habitability certificate before buying: without it, you cannot let legally.
  • Count your properties: from five homes in Catalonia, your landlord obligations change.
